Terms of service
The agreement between us and the businesses who use Toby. Written in plain English.
The agreement
These terms are between you (the business signing up) and After Hours. By creating an account you agree to them.
What we provide
An AI assistant that answers calls forwarded to your Toby number, takes details and sends them to your dashboard, plus the dashboard itself. We aim for it to be available all the time but can't promise it will never go down; we'll fix problems as fast as we can.
Free trial and payment
You get 14 days free. After that it's £99 a month, paid in advance by card through Stripe. If a payment fails we'll tell you; if it isn't sorted within a few days Toby stops answering until it is.
Cancelling
Cancel any time from your account page. You won't be charged again, and Toby keeps answering until the end of the period you've paid for. There are no refunds for part months.
Your responsibilities
- Keep the information you give Toby accurate, especially prices and opening hours
- Ring callers back as Toby promises
- Don't use the service for anything illegal, for cold calling, or to mislead people
- Keep your password safe
What Toby is not
Toby is not an emergency service and does not give professional advice. He takes messages and booking requests; you're responsible for confirming bookings and anything you agree with a customer.
Callers' data
You're the controller of what your callers tell Toby. We process it only on your instructions to run the service, keep it secure, use only suppliers bound by data protection terms, help you with requests from callers, and delete it when your account closes. These terms are our data processing agreement with you.
Liability
We're not liable for lost business or profits from a call that wasn't answered or a message that wasn't passed on. Our total liability is limited to what you paid us in the last 12 months. Nothing here limits liability that can't be limited by law.
Changes
If we change these terms or the price, we'll email you at least 30 days before. You can cancel if you don't agree.
Law
These terms are governed by the law of England and Wales.
